Ex-EALA boss sued over death of a Boda-Boda cyclist

The former Speaker of the East African Legislative Assembly, Daniel Fred Kidega has been dragged to court by a family member of a boda-boda cyclist who was allegedly knocked down by his vehicle. 

Yesterday, Gerald Sebandeke filed the suit at the civil division of the High court seeking sh19.5m in damages.

Kidega was sued alongside his driver Elvis Kinen.

Sebandeke alleges that On March 8, 2019, at about 11pm, late Francis Nakibinge was riding his Motor Cycle Registration number UDY 286Z, carrying a passenger from Bweyogerere heading towards Kireka, in Kampala.

Court documents indicate that at about the same time, Kinen was driving a motor vehicle registration number TCD 694 EAC Toyota Land cruiser belonging to Kidega after the roundabout at Namboole Stadium heading to Bweyogerere the direction where the deceased was coming from.

It is further alleged that Kinen (Driver) negligently drove the said vehicle at a high speed in a corner, after the roundabout at Namboole Stadium upon which he lost control   and run over late Nakibinge in  a head  on collision which caused  his death.

"Following the accident, late Nakibinge died instantly and the passenger sustained serious injuries for which he was hospitalized," reads part of court documents.

He claims a Police case of a fatal accident was reported at Bweyogerere Police Station where investigations were conducted and a police report was issued to the deceased family.

According to the court documents, Sebandeke says due to the driver's negligence that caused the death of Nakibinge, his family has suffered emotional and financial loss since he was the sole bread winner.

Sebandeke wants an order directing Kidega and his driver to compensate the deceased family for loss of dependency for his children.

The deputy court registrar Sarah Langa has summoned Kidega and his driver to file a defence within fifteen days.

"Should you fail to file a defense within the specified period, the plaintiff shall proceed with the suit and judgement shall be given in your absence," she warned.
