KAMPALA - The High Court has deferred a case in which a member of the Uganda Young Democrats (UYD) is seeking orders against Police boss, Godfrey Bangirana to vacate office.

Today, the court registrar, Sarah Langa adjourned the case to October 4, 2019 because the Deputy Head, Civil Division of the High Court, Justice Henrietta Wolayo was absent.

The judge was expected to hear a temporal injunction application in which Isaac Maddo is seeking orders, restraining Bangirana from holding office of the director of engineering and logistics, receiving salary and emoluments and acting on behalf of Government, pending final determination of the case.

Through Kirya and Company Advocates, Maddo also wants court to restrain the Police Authority from renewing Bangirana's contract until the case is determined.

Maddo says Bangirana's contract expired in July 16, 2019 and has not been renewed to date but has continued to hold office, which is unlawful and illegal.

However, the hearing of the application of temporal injunction did not take-off because Justice Henrietta Wolayo was absent. The case has been adjourned to October 24, for hearing.

A temporary injunction is a court order prohibiting an action by a party to a lawsuit until there has been a trial or other court action.

Bangirana has also never filed defence concerning the matter, despite summons by the court registrar, Sarah Langa. According to Maddo, they served Bangirana and the Attorney General (AG) with the summons.

The registrar had directed Bangirana and AG to file their defence within 15 days, an order they have not followed.

Contract  
Court documents indicate that Bangirana has acted or worked as a police officer at the rank of Assistant Inspector General of Police (AIGP) and director logistics on a two- year contract.

Following expiry of his (Bangirana's) contract on July 16, 2019, the Inspector General of Police (IGP), Martin Okoth Ochola ordered Bangirana to hand over office, stating that his continued stay would raise several queries from the Public Service.

However, the Permanent Secretary (PS) Ministry of Internal affairs, Benon Mutambi wrote to Ochola, instructing Bangirana to remain in office, pending renewal of his contract and he (Ochola) reversed his order.

Bangirana applied to have his two-year contract renewed through the secretary of the Police Authority recently, but it has not yet been done.

He contends that Bangirana has continued to draw a salary and emoluments on the consolidated fund, which is a public property and therefore it has to be preserved and protected from abuse and wastage.

Maddo claims that the defendants are transgressing the law in a way that offends him as a citizen and taxpayer. "I seek an order that the officer refunds all the salary and emoluments received while in office illegally."

In a recent Police Advisory Committee meeting, Ochola reportedly asked all directors whose contracts were due to expire to prepare to handover to their deputies because the appointing authority will not reportedly renew their contracts.

Maddo contends that he shall adduce evidence to show that the actions of government in failing to advice the PS and other government organs constituted a breach of his duty.

Probe
He is also still under a probe by the Inspectorate of Government over allegations of mismanaging procurement deals.

The probe stems from a whistle blower's allegations to the inspectorate, including the purported inflation of the cost of construction of Natete Police Station, which caused a financial loss of over sh200b to the force through the supply of fuel to individuals and accumulation of the institution's debts to more than sh100b.
