Rugyengye says Prof. Augustus Niwagaba has made several promises and guarantees to pay the outstanding amount, but in vain.

COURT

KAMPALA - A man has dragged Makerere University professor Augustus Niwagaba to court, demanding sh102m in debt.

In a suit filed at the civil division of the High Court in Kampala on Monday, Justus Rugyengye says Niwagaba gave him six cheques totaling to sh102m, which have since been dishonored by the bank.

Court documents show that Niwagaba issued Rugyengye with the cheques on August 7 last year.

"Niwagaba issued the cheques to me with a handwritten acknowledgment/admission of the debt with commitment to clear it by January 31, 2018," Rugyengye revealed.

He says Niwagaba has made several promises and guarantees to pay the outstanding amount, but in vain.

He also argues that the professor's conduct of not clearing the debt has subjected him to unnecessary financial loss and costs for instituting the suit.

"Several demand notices were duly issued to Niwagaba, who utterly disregarded the same and refused to acknowledge receipt of them," the man who is suing contends.

Rugyengye, therefore, seeks payment of the said amount of money (sh102m) with interest from the date of judgement till payment in full at the rate of 20% per annum and costs of the suit.

The court is yet to summon Niwagaba to file a defence in regard to the stated allegations.
