Marie Stopes sues director over lost fund

KAMPALA - Marie Stopes Uganda (MSU) has dragged its former contraceptive social marketing head, Henry Mulunda, to court, seeking to recover sh185m that he borrowed from the organisation.

Through Sebalu and Lule Company Advocates, the organisation contends that Mulunda promised to pay the money in installments in vain.

MSU filed the suit against Mulunda on Thursday at the Civil Division of the High Court in Kampala.

In its suit, MSU states that it owes the money as per the reconciliation report and the admission. Mulunda occasioned the loss during the course of his employment.

The organisation also wants court to compel Mulunda to pay interest at the rate of 20% per annum from the date of judgement until full payment, costs and any other relief that court deems proper.

MSU contends that on October 17, 2017, Mulunda admitted to having occasioned loss to it (Marie Stopes) and undertook to refund the amount in installments.

"Mulunda failed to honour the payment plan and has since failed to refund any of the money," MSU states in its plaint.

The organisation also asserts that it has made several demands to Mulunda to make good of his undertaking under the terms of the payment plan, but all the attempts have been futile.

The organisation says Mulunda's conduct has made it suffer loss for which he is liable and has no defence.

The court registrar, Sarah Langa, has ordered Mulunda to file his defence within 15 days.
