Dr. Ssali seeks to pay sh50m for deceased patient

Dr. Ssali wants the case to be decided through an out of court settlement before hearing of the case commences.



Fertility doctor Edward Tamale Ssali has offered to pay sh50m for deceased Mercy Ayiru.

In a letter directed to the Civil Division of the High Court in Kampala, Dr. Ssali proposes to pay sh50m, inclusive costs in installments in six months from the date the relatives of the deceased approves the offer.

"Our client would like to make an offer in full and final settlement of this case to your client in the sum of sh50m, inclusive of costs," states part of the letter from Tumusime, Kabega and Company Advocates. The law firm represents Dr. Ssali.

The letter was copied to KMA Advocates, a law firm representing Dr. Mulburga Atcero, the sister of the deceased.

Dr. Ssali wants the case to be decided through an out of court settlement before hearing of the case commences. The case, which is currently before Justice Margret Oguli-Oumo, the deputy head-civil division is scheduled for February next year for hearing. 

Court documents indicate that the two doctors negligently caused the death of one Mercy Ayiru, during an operation at the Women's Hospital International and fertility center, then called Kampala Gynecology and Fertility Centre in October 2010.

According to prosecution, the duo failed to ensure that the tube which was supposed to supply oxygen and anesthesia to the patient's lungs inserted properly into the deceased's trachea, before embarking on the surgery.
