The Court of Appeal has declared National Resistance Movement (NRM)'s Robert Kasule Sebunya the Nansana Municipality MP.
This is after a panel of three justices led by out-going Deputy Chief Justice Steven Kavuma threw out Wakayima Musoke Nsereko from Parliament on grounds that he was not validly nominated by the Election Commission (EC), since he was not a registered voter.
Kavuma was assisted by Chebrion Barishaki and Hellen Obura. This means Democratic Party's (DP's) Wakayima will now have to wait until 2021, when parliamentary elections will be conducted.
"Since Wakayima was nominated in error and did not qualify for the seat. We declare Kasule who got the highest number of votes among other candidates as Nansana MP," the justices ruled.
They observed that Musoke Hannington Nsereko who appears in voters' register of Nansana Municipality is different from Wakayima Musoke Nsereko.
The justices said although there was no other Musoke Hannington Nsereko, he was not at liberty to change his name without following the law.
After the court's ruling, devastated supporters of Wakayima broke down in tears and threatened to attack Kasule if he ever stepped in Nansana.
