MP Kabaziguruka to go on trial in November

The Nakawa MP will on Thursday appear before the High Court for his bail application

The hearing of a treason case against Nakawa MP Michael Andrew Kabaziguruka and his co-accused at Army Court is slated to start on November 18.

This was after prosecution led by Major Raphael Mugisha on Tuesday informed court that investigations into the case are complete.

"Chairman, investigations into this matter are complete," Mugisha said.

This prompted the General Court Martial led by Lt General Andrew Gutti to set the hearing date.

The defence team led by Maj. Asha Patra asked court to compel prosecution to disclose to them evidence it intends to use during the trial.               

The accused are battling offences relating to security and treachery (treason) contrary to section 130 (1) (f) and 129(a) of the Uganda Peoples Defence (UPDF) Act of 2005. Treason and offences relating to security carry a maximum penalty of death on conviction.

The accused were remanded to Makindye Military Barracks and Kigo government prison for civilians.

Prosecution alleges that the accused and others still at large between February and June 2016 at diverse places in Wakiso, Kampala and Luwero districts with intent to prejudice the security or interests of Uganda committed acts of treachery, infiltrate the UPDF and engaged themselves in war like activities against the government.

Prosecution further alleges that the accused and others still at large in the same months and places plotted to overthrow the government by use of arms.

Kabaziguruka will on Thursday appear before the High Court presided over by Justice Yasin Nyanzi to hear his bail application.

His bail was frustrated last week by the Directorate of Public Prosecution, informing court that he does not appear in matters being prosecuted by the Army Court.
