Kawempe Mayor Munyagwa sued over land

KAWEMPE Division Mayor Hajj Mubarak Sserunga Munyagwa has been dragged to court for breach of contract.

Munyagwa's accuser, John Baptist Maali, filed his case in the Commercial Court on January 28, 2016 seeking to recover a total of sh100m that he allegedly paid to him for a piece of land, but failed to deliver or hand over the property to him.

Maali also seeks for orders compelling Munyagwa to pay him general damages for causing him to suffer inconveniences, loss and discomfort for having deprived him quiet use and enjoyment of the property he paid for value; as he (Munyagwa) continued to benefit from the consideration he received from him.

Suing through Lutaakome & Co. Advocates, Maali also seeks for interest of 24% of the money owed to him by Munyagwa.

Maali further alleges that in February 2015 Munyagwa, who was in company of his agent known as Meddie Basajja, approached him purporting to be the equitable owner of the piece of land comprised in Kyaddondo Block 209, Plot 509 situated at Kalerwe in Kampala, measuring approximately 0.316 hectares, which he desired to sell to him.

It was further alleged that Munyagwa would procure a certificate of title for the land from Kampala District Land Board (KDLB).

However, upon inquiry as to whether the purported seller was the owner of the land and whether it had a certificate of title, it was revealed that he was an assignee of a lease offer from Bakali Ssentongo, and an owner of an equitable interest in the property; although at the time, the title was being processed.

Meanwhile, the court has summoned Munyagwa to file a written statement of defence within 15 days, failure of which, it would proceed to hear and determine the plaintiff's case without him.
