EIGHT Kenyans charged in connection with the Kampala twin bombings have sued the Attorney General, saying they were illegally arrested.

EIGHT Kenyans charged in connection with the Kampala twin bombings have sued the Attorney General, saying they were illegally arrested.

They are Hussein Hassan Agad alias Hussein Agade, Mohammed Adan Abdow, Idris Magondu alias Christopher Magondu, Mohammad Hamid Suleiman, Yahya Suleiman Mbuthia, Habib Suleiman Njoroge, Omar Awadh Omar, and Ismail Abubaker.

The suspects, on remand at Luzira Prison, were arrested in Kenya on different dates and extradited to Uganda.

The suspects have applied for a judicial review of the circumstances under which they were arrested and extradited to Uganda, saying due process of law was breached.
“No extradition proceedings were ever undertaken against the applicants before any lawful court of competent jurisdiction in the Republic of Kenya,” the suspects argue.

The principles of Judicial review arise where there is a decision to be reviewed or to compel a statutory body or officials to perform them where they have failed.

The suit was jointly filed through three law firms; Rwakafuuzi and Company Advocates, Ondimu and Company Advocates and Mukiibi, Kawooya, Onyango, and Company Advocates.

In September, a Kenyan judge, Mohamed Wasarme attacked the Government for sending Kenyans to Uganda to face the charges in breach of the law.
