Ex-Busoga katukiro warned of legal action

LAWYERS representing the Busoga Kingdom have written to the former Katukiro (prime minister), Wilson Muwereza, to immediately vacate office or face
criminal prosecution.

“You have continued to hold out as Katukiro of Obwa Kyabazinga bwa Busoga without legal mandate and publicly disparaged the office of the acting Kyabazinga, thereby holding the kingdom in contempt,” said the May 27 letter by Muwema and Mugerwa Advocates.

“You again have disobeyed court orders by contemptuously and publicly claiming that the orders were ineffective.”

Muwereza was quoted in the press as having rejected the reshuffle in which he was dropped as prime minister.

“Utterances that were attributed to you in the press tend to overthrow the constitutional order of the kingdom and threaten the delicate cohesion and harmony of Busoga. The impunity with which you are handling yourself ever since you were relieved of office on May 22 can’t be left unanswered,” the letter further read.

The lawyers also demanded an apology from Muwereza, insisting that they and the entire Basoga community must first approve the text.

They warned that if Muwereza did not comply with their demands, they would start legal action that would lead to his arrest and prosecution.

The offences, they added, would include criminal trespass, disobedience of orders, impersonation, making documents without authority, libel and false assumption of authority.

They said they would also take civil action against him for contempt of court following a constitutional petition of 2008 and an election petition of 2009, as well as for defaming the acting Kyabazinga.

According to the letter, after the demise of Kyabazinga Henry Muloki in September 2008, the Isabalangira (chief prince) automatically became the acting Kyabazinga pending the election of a substantive one.

In October 2008 an attempt was made to install Edward Columbus Wambuzi, son of the late Muloki, but the election had lacked a quorum of the Chiefs Royal Council as provided in the Busoga constitution.
