NEMA wants sh7m for razing Nyakana’s Bugolobi house

THE National environment Management Authority (NEMA) is demanding sh7.76m as costs incurred while demolishing Kampala central division chairman Godfrey Nyakana’s house.

NEMA Executive Director Dr. Aryamanya Mugisha on Tuesday said Nyakana was required by law to pay the money used to demolish his Bugolobi house on January 7, 2005.

Mugisha was appearing before Nakawa Chief Magistrate Deo Nizeyimana. He was the third witness in a case in which Nyakana is accused of refusing to pay demolition costs.

“NEMA incurred the following expenses for the two-day operation: fuel, airtime, allowances for drivers and policemen deployed during the operation,” Mugisha said.
NEMA had earlier issued Nyakana with a notice of intention to recover the costs, which he ignored.

“As a civil debt, NEMA caused a lawful demolition of your structure due to failure, negligence and refusal to vacate the place and as a result you have to meet sh7.76m,” read the notice.

Mugisha said Section 68 of the National Environment Act Cap. 153 provides that anybody who builds in the wetlands should vacate with demolition costs.

Nyakana meantime remained composed and silent throughout the court proceeding.
Nizeyimana adjourned the case until July 19.
