SAVE Our Soccer (SOS) has written to the registrar general requesting for the deregistration of FUFA Limited.

In a letter signed by group lawyer Fred Muwema and copied to the Attorney General and National Council of Sports (NCS) secretary, SOS states that the registration of FUFA is both untenable and “an abuse of the corporate governance of the Company Laws justice system”.

The pressure group argues that “FUFA Limited was mutated from an association to a company on the inside, but virtually retained its public outlook as a voluntary national association affiliated to and recognised by NCS.

“The registration of FUFA Ltd could not be done without the statutory endorsement and secondment by NCS which in fact was not obtained at the time of registration.”

The letter goes on to say that though FUFA Ltd. objectives take a national character like organising the national team and international competitions and obtaining FIFA grants, these interests can not be pursued by a private company unless there is a statutory order or government consent.

Muwema goes on to argue that FUFA Ltd objectives of organising football for the public or social and voluntary, which makes it a Non Governmental Organisation, hence they failed to follow the procedure as stipulated in Section 2 (3) of the NGO Registration Act (cap 13) which requires them to first register with the board before it is incorporated under the Company Act or Trustees Incorporation.

Muwema, who blames FUFA Ltd for failure to show its membership and file annual returns, says that it is a misrepresentation and can not carry on the business it was incorporated to do, but was an instrument to convert national resources.

“It’s our humble request therefore that your office issues a notice to FUFA Ltd with the intention of striking its name off the Company Register.”
