Kiboga speaker defies Bidandi

Kiboga district speaker has written to the local government minister, Jaberi Bidandi Ssali, refusing to take the responsibility to oust the embattled LC5 chairman, Siraje Nkugwa, from office, reports <B.Jude Etyang.</B>

“Hon Minister, the duties and functions of the district council speaker are well stipulated in Section 12 of the Local Governments Act and as such I cannot take the responsibility of ensuring that the chairperson hands over the office to the vice-chairperson as requested because this would cause legal implications for the council. Since this matter is before court, the removal of the chairperson should be done through a court order,” Abdul Mutumba said in a October 17 letter.
Nkugwa’s election was nullified by the high court but he appealed against the order.
Bidandi issued an order last week that Nkugwa vacates office and hands over to the vice.
Mutumba referred Bidandi to the controversial letter from the Registrar of the Court of Appeal telling the chief administrative officer that Nkugwa should stay in office until the appeal court passes its judgement, like members of parliament do.
Mutumba said the CAO’s position was a practical one which should prevail.
