THE murder trial of Kampala International University (KIU) student Jane Ndichu, who allegedly stabbed her lover David Musunga, flopped yesterday due to the absence of one of the assessors.

The High Court in Kampala had been scheduled to proceed with further hearing of prosecution witness testimonies. However, the trial judge Jane Kiggundu informed court that Herbert Ojuka had unexpectedly said he would be unavailable for the day.

Ndichu, 21, allegedly murdered Musunga on March 10 last year at their one-roomed apartment in suburb of Kansanga near the university.

The deceased, also a student at the university, was allegedly stabbed on the throat with a knife and bled to death. The duo purportedly had a domestic row.

The state prosecutor Julius Tuhairwe, requested court to proceed, saying the other assessor John Musana would brief his colleague on what would transpire.

But Ndichu’s lawyer Rose Sengendo, asked for an adjournment, saying it would be unfair for the trial to proceed without the presence of the absent assessor.

Accordingly, the judge adjourned hearing to tomorrow (Friday September 23).She however warned that in the event that the assessor was again absent, hearing would proceed.

“If the assessor is not here on Friday, court will proceed and hear the case,” the judge said.

Seven prosecution witnesses have so far testified. Ndichu has denied the charge.
