The Nakawa Chief Magistrate’s Court has dismissed charges of incitement to murder security personnel against National Unity Platform (NUP) deputy spokesperson Alex Waiswa Mufumbiro.
On February 12, 2026, Grade One Magistrate Frank Namanya ruled that the charges were defective because the prosecution failed to specify the exact location where Mufumbiro allegedly incited NUP youths.
The magistrate noted that the charge sheet only indicated that the alleged offence occurred within Kampala district, without identifying a specific place. This omission created ambiguity and denied the accused the opportunity to adequately prepare his defence.
As a result, the court dismissed the case for lack of territorial or geographical jurisdiction.
However, Mufumbiro, who recently lost the Nakawa East Constituency parliamentary race, was returned to Luzira Prison to face other pending charges before the Kawempe Court.
Background
Last year, Mufumbiro was slapped with fresh charges of inciting the public to murder security personnel.
He appeared before Grade One magistrate Frank Namanya and denied the count of incitement to commit an offence.
It is alleged that on September 4, 2025, within Kampala City, incited NUP supporters to commit an offence against Ugandan security personnel, to wit murder.
Mufumbiro was duly nominated to contest for the Nakawa East MP seat while in prison. However, he lost the election to NRM's Fred Ruhindi.
