Lusaze-based pastor remanded over family land

MUKONO - The Nakifuma Magistrates’ Court in Mukono district has charged and remanded a pastor to Nakifuma Prison on allegations of defrauding his family's ancestral piece of land located at Lusera village in Kasawo, Mukono.

Grade One Magistrate Peter Gukiina sent on remand Pastor Polycarp Bingi Mutagubya of Lusaze Christian Fellowship.

The state prosecutor, Josephine Nanyonga, from the Office of the Director of Public Prosecutions (ODPP), informed court that investigations regarding the case were still ongoing, prompting the Magistrate to adjourn the case.
 
“Your honour, inquiries regarding the case before you are still ongoing. We, therefore, pray for a short adjournment,” Nanyonga said, adding that they could not proceed with responding to the accused’s bail application on grounds that the defence lawyers did not serve them, and neither uploaded the bail document on the judiciary’s Electronic Court Case Management Information System (ECCMIS).

This prompted Magistrate Gukiina to remand the accused, saying, “Since the state was not served to verify the sureties’ documents by the defence, this case is adjourned until February 2, 2026, and the accused is remanded till then.”

Court documents indicate that the accused, Bingi, failed to provide ancestral land documents of the late Eveltius Mutagubya’s family to his siblings, an act the family says he did to defraud their land.

The said land, according to court documents, is located at Lusera village in Kasawo, Mukono district.

Report to Police

Led by Jane Mbabazi and Daniel Ssekyanzi, family relatives decided to report the matter to the police after various attempts to persuade the accused to bring the ancestral land documents to the family, but in vain. 

This prompted them to report to Kasawo Police Station under SD REF 22/24/10/25
on October 24, last year, prompting a police investigation and arresting the accused.
