Doctor charged over allegedly defrauding pastor

A former dental surgeon at Mulago Hospital in Kampala city has been charged with giving false information and uttering false documents regarding a city land.

Ntwatwa Sikiziyivu Lule, 64, is charged with businessman Stuart Mulangira Katerega, 55. Ntwatwa is a resident of Agrey Zone Ndeba parish Lubaga division Kampala district, while Katerega resides in Munyonyo, Kampala's, Makindye division.

Appearing before Law Development Centre (LDC) Court grade one magistrate Martins Kirya on May 6, 2024, Ntwatwa denied the charges.

His co-accused, Katerega, did not appear in court, prompting the magistrate to issue criminal summons against him.

The duo is charged with giving false information to a person employed in the public service, contrary to Section 115 of the Penal Code Act; conspiracy to defraud, contrary to section 309 of the same Act; and uttering false documents, contrary to section 351 of the same Act.

The offences attract three years imprisonment on conviction.

Defence lawyer Umaru Nyanzi asked the court to grant bail to Ntwatwa and he was released on a non-cash bail of sh500,000 after presenting substantial sureties in court.

Prosecution led by Timothy Aduti alleges that in 2019 at Wandegeya Police Station, Kawempe division, Kampala, Ntwatwa and Katerega gave a Police officer information, which they knew or believed to be false that they were the rightful owners of the ‘kibanja’ opposite the Government Analytical Laboratory at Mulago roundabout, Kimwanyi zone, Kasule Road.

Prosecution further alleges that the duo conspired to defraud Pastor Daniel Walugembe of his kibanja opposite the Government Analytical Laboratory Mulago roundabout claiming to have bought it from Bulasio Bwiso in the early1990's.

According to the complaint, Walugembe, he bought 15 acres of the land in 1996 from Bwiso, Jonathan Masembe, among others, but the accused persons allegedly grabbed one-acre of his land.

Prosecution also alleges that on September 17, 2020 at Wandegeya Police Station, the accused (Ntwatwa), knowingly and fraudulently uttered false documents, namely, ‘busulu’ receipts (ground rent receipts) to police officers, purporting to have been issued to him by the family of Ashe Sendawula Mukasa.
