The Anti-Corruption Court in Kampala has directed that written submissions be filed in a case in which the former Karamoja affairs state minister Agnes Nandutu is accused of diverting iron sheets meant for Karamoja region.
When the case resumed on November 5, 2025, defence lawyer Charles Nandah Wamukota informed the court presided over by acting Principal Judge Jane Okuo Kajuga that Nandutu was unwell.
The court heard that Nandutu had collapsed last week on the floor of Parliament and was admitted to Nakasero Hospital, where she received treatment before being discharged on Saturday (November 1).
Justice Kajuga directed prosecution, led by David Bisamunyu, to file written submissions by November 14, 2025. The defence is to file a reply by November 28, 2025, and the state may file a rejoinder, if any, by December 5, 2025.
The judge will sum up the case to the assessors on December 12, 2025. Court assessors are non-lawyers who sit with judges to advise the court in evaluating cases; however, their opinions are not binding on the judge.
Nandutu, who is also the Bududa district Woman MP, is charged with the offence of dealing with suspect property, contrary to Section 21A (1) of the Anti-Corruption Act.
The offence carries a maximum sentence of seven years in prison, on conviction.
The case
Prosecution alleges that Nandutu between June and July 2022, at the OPM stores in Namanve, and in Kkola Cell, Bulwanyi Parish, Mukono district, dealt with government property, namely, 2000 pre-painted iron sheets of gauge 28 marked “Office of the Prime Minister”, by receiving and holding the items, which she had reason to believe were acquired as a result of loss of public property, an offence under Section 10 (1) of the Anti-Corruption Act 2009.
On the other hand, Kitutu, who is the Manafwa district Woman Member of Parliament, faces two counts of loss of public property and conspiracy to defraud at the Anti-Corruption Court together with her brother, Michael Kitutu Naboya and personal assistant Joshua Abaho.
