Akright loses appeal over sh51m debt

Court of Appeal Judge Eva Luswata has dismissed an application by Akright Projects Limited against H&L Exporters Uganda Ltd, seeking to halt the payment of a debt totalling shillings 151 million.

The dispute stemmed from the sale of a 10-acre land parcel valued at approximately shilling1.1 billion, leaving a balance of shillings 151 million unpaid.

Akright Projects Limited, represented by Tumusiime, Irumba & Company Advocates, sought to stay the execution order, claiming a potential substantial and irreparable loss.

However, H&L Exporters Uganda Limited, represented by Anguria & Company Advocates, opposed the application, citing a consent judgment requiring Akright to pay the specified sum, which they failed to honour.

In her ruling dated February 23, 2024, Justice Luswata stated that the balance of convenience favoured H&L Exporters Uganda Limited, noting that they had been deprived of a tangible remedy despite being the successful party since July 2014. She noted that the circumstances strongly favoured granting relief to the respondent.

“It is evident that the respondent who was the successful party since July 2014 has been deprived of tangible remedy, despite owning the decree. In my view, under those circumstances, the balance of convenience is tilted strongly in their favour,” Justice Luswata said.
