The Judiciary has clarified that Commercial Court judge Stephen Mubiru dismissed a case involving businessman Patrick Bitature and a South African firm, Vantage Mezzanine Fund II Partnership for lack of merit.

In a press release issued dated May 26, Judiciary said contrary to lawyer Fred Muwema’s claims, the case was not dismissed on any ground related to the Electronic Court Case Management Information System (ECCMIS).

“The Judiciary would like to re-affirm the position that ECCMIS is among the many vital innovations and reforms intended to ensure proper case management and effective administration of justice,” the statement reads in part.

After dismissal of the case, the judge directed Muwema to pay the costs of the application, saying he did not professionally advise the businessman and his companies not to institute a case that he said lacked a legal basis.

However, in an interview with a local newspaper, Muwema blamed ‘deficiencies’ of the Electronic Court Case Management Information System for the loss of the case, which the Judiciary says is false.
