Why Molly Katanga was denied bail

The judge said that despite substantial sureties, he could not grant bail to Molly Katanga because the law requires the medical exception to be certified by Luzira Prison.

The High Court in Kampala has declined to grant bail to Molly Katanga, 55, citing a lack of medical certification from the medical facility of Luzira Prison.

Molly Katanga, who faces charges in connection to the death of her husband, businessman Henry Katanga, had sought bail through her lawyers led by Peter Kabatsi and MacDusman Kabega contending that she has an urgent need for medical attention, owing to the injuries she obtained in the alleged domestic fight with her late husband on the night of his death.

Molly Katanga also argued that her status as a primary caregiver and the sole breadwinner for her family underscored her longstanding reputation as a law-abiding citizen.

However, in his ruling, Justice Isaac Muwata who presided over the court dismissed Molly’s bail, saying that he is yet to receive any communication from the Luzira prison medical department regarding the suspect’s medical needs.

Initially, Molly Katanga through her lawyers had asked Luzira Prison for certification of her medical situation in regards to injuries obtained on November 2nd, 2023.

However, the Prison Medical Facility instead deferred the matter to Mulago Hospital, this would later complicate Molly Katanga’s situation as the Judge insisted that the the law requires the medical exception to be certified by Luzira Prison and not Mulago Hospital.

Despite sustaining grave injuries on her head, Molly has been on remand since February. Molly appeared in court via Zoom technology. She wore a bandage on her head.

Katanga, a renowned businessman succumbed to a gunshot wound he sustained on the left side of his head after an alleged verbal exchange with his wife (Molly) on November 2, 2023, at their residence at Mbuya Chwa II Road.

Prosecution alleges that on November 2, 2023, at Mbuya Chwa II Road in Nakawa division, Kampala city with malice aforethought, Molly killed her husband in cold blood.

According to the indictment, Katanga succumbed to gunshot injuries discharged by his pistol number UG1622200061CZ99 compact.
