Court set to rule on Mulago Hospital missing baby case

The High Court will today deliver judgment in a case where a couple sued Mulago National Referral Hospital over the alleged mysterious disappearance of one of their babies shortly after birth.

Last week, Justice Lydia Mugambe informed the parties in the case that the judgment was not ready.

"The judgment in your case would be ready on Tuesday on January, 24, 2017 at 4:00pm," Mugambe stated. 

Michael Mubangizi and his wife Jennifer Musiimenta sued Mulago Hospital executive director Dr. Byarugaba Baterana jointly with the Attorney General (AG) seeking for orders against the hospital to surrender their baby dead or alive.

According to Mubangizi, following the disappearance of their child, they filed a case at Mulago Police Post and after two days, the hospital administration gave them a body of another baby claiming that their baby had passed on.

However, being suspicious of the dead body, they carried out a DNA test on the body which showed that they were not the biological parents of the deceased.

Consequently, they continued to demand for their baby from the hospital administration but all in vain and no explanation was given to them until they decided to petition court.

The couple contends that their family has suffered mental torture and their right to parenthood and health was violated by the hospital.

They also claim that the mortuary entries of March, 14, 2012 do not show any body registered by their names.

The couple that is being supported by Human Rights and Development says it has a feeling the baby is still alive because Mulago Hospital has never released the actual body to date.

Mubangizi, a mechanic in the city suburbs of Kyebando said that after five years in court, they want Mulago to surrender their baby to them dead or alive.

Agnes Tugineyo, a paternal aunt of the twins, said she still wonders where the body of the baby that was first given to them was got from and the explanation that was given to its parents.
