Makindye magistrate’s court has adjourned the hearing of MP James Kakooza’s divorce case to April 2nd and 3rd after the two parties failed to submit their applications.

Kakooza the former state minister for health was dragged to court early this year by his former wife Enid Tuhirirwe asking for dissolution of her four year old marriage on grounds of adultery.

Tuhirirwe also seeks custody of their two kids Brian Kakooza and Byanne Kakooza and part of their family property.
Court could not proceed with the hearing as scheduled because both the applicant and correspondent had not filed their application to the main suit.

Kakooza’s lawyers Ivan Engoru last month applied to court to allow his client’s (Kakooza) daughter Brenda Nabona together with her “boyfriend” Geoffrey Busingye to be co-respondents to the suit, which court allowed.

He informed court that he has not yet amended his application to include the two co-respondents.

The case was before the chief magistrate Charles Sserubuga in his chambers with all parties present.

Court also asked Tuhirirwe and her lawyer Hilary Kizige, to file a proper application on the interim maintenance order.

Tuhirirwe had earlier on applied for an interim maintenance order but court asked them to make it formal after Kakooza’s lawyer objected to it, saying it was pre-mature and irregular at a time.

She wants to Kakooza ordered to provide maintenance to her and the children. Tuhirirwe says Kakooza was no longer supporting her and their two kids. Tuhirirwe accuses the ex-minister of impregnating their daughter Nabona.

But Kakooza also the Kabula county MP denies all the allegations saying the child belonged to his daughter’s boyfriend.
He also denies being the husband to Tuhirirwe saying that she is not entitled to the remedies she wants. He said though they got kids, their relationship was casual.

Tuhirirwe claims she was married to Kakooza since 2007, claiming that they also had a Kinyankore customary marriage in 2008, where Kakooza paid eight cows.

Problems started in 2009, after Nabona conceived and gave birth to a baby whose father Tuhirirwe says was not known.
Tuhirirwe said she suspected Kakooza because he always visited the girl’s room at night claiming it was the only time he could talk to her.
