By Hillary Nsambu and Charles Ariko BUBULO East MP Michael Mumia was yesterday ordered by the Court of Appeal to immediately quit Parliament. He presented forged paper papers at nomination. Justices Galdino M. Okello, Joseph Patrick Berko and Constance Kategaya Byamugisha unanimously upheld the High Court judgment and orders, saying the election should be set aside as Mumia’s election is annulled. “I find Mumia to be nothing, but an impostor. I agree with the trial judge that the certificate, which Mumia presented, did not belong to him. It has been found to be forged,†Justice Berko, who made the leading judgment said. “Now that the forgery has been exposed, he cannot rely on that certificate to maintain his seat in Parliament,†the judge said. Berko directed the registrar of the Court of Appeal to send copies of his judgment to the Minister of Education and Sports, the Attorney General and the UNEB secretary. Following this judgment, Mumia will be barred from contesting in the subsequent by-election, as it has been found that he did not possess a requisite academic qualification. Mumia’s opponents in the 2001 Parliamentary elections, which he won, included Patrick Nabutaala Nabisi and Simon Mulongo. The two, being dissatisfied with the election, petitioned the High Court in Mbale. Justice Rugadya Atwooki found that Mumia was not qualified to be elected MP, as he had with full knowledge presented a forged “A†Level certificate to the Electoral Commission. Mumia, who claimed that he obtained the certificate from Nkoma SS, appealed to the Court of Appeal, blaming the trial judge of disqualifying him and annulling his election. While Mumia’s name is Michael Mumia, the certificate he presented for nomination was in the name of Mumia Michael Omangongo. Mulongo had told court that he (Mulongo) studied at Nkoma SS and Mumya Michael Omangongo is the real person he knew to have attended that school together with him between 1983 and 1985. Ends
