THE government, Makerere University Business School (MUBS) and Makerere University Kampala (MUK) have agreed to have an out of court settlement on who has exclusive rights to run the Bachelor of Commerce External programme and the Masters of Business Administration, among others.

Hillary Kiirya
reports that the acting director of Civil Litigation, Joseph Matsiko, yesterday told Justice Aweri Opio that he had instructions from the Attorney General to have the matter amicably settled since both are government institutions.

Matsiko told court that they could not continue seeing two government institutions fighting each other over such an issue, as if the matter cannot be settled.
Muzamiru Kibedi and Henry Rwaganika for MUBS and John Fisher Kanyemibwa for MUK agreed to the proposal.

The judge, who was also pleased with the proposal, gave the parties one week to meet and settle their differences and encouraged them to report with positive results. They return to court on November 10.

MUBS sued MUK and the National Council for Higher Education, seeking among other things, a court order to be declared an independent public university affiliated to MUK for its awards. The wrangles began in 2002.

The lawyers requested court for an order requiring the National Council for Higher Education to formalise, recognise and register MUBS as an affiliated Public Tertiary Institute.
