Kagaba had just convicted Gilado Musisi, 28, for defiling a three and half year-old-girl when he raised the question in the High Court on Monday.
“You are asking me for mercy but were you merciful when you stretched the little girl’s legs and pumped her with your penis?” he asked amid faint laughter from lawyers attending the session.
“I am very disturbed. I do not even know what kind of sentence to give you,” he said. “I am not merciful at the moment to pass the sentence but produce him on October 31 for an appropriate sentence,” he added.
Musisi, a resident of Nalwale in Luweero was charged with defilement. He is the second offender to be convicted of defilement before the same court in less than 24 hours.
State attorney Sam Oola told court that Musisi had unlawful carnal knowledge of a three and half year old girl in April last year.
He said the accused committed the offense at Nalwale village in Luweero district on a bright day of April 22, 2001.
The trial court also heard that Musisi was a porter at the victim’s parents’ farm when he committed the offense for which the High Court has found him guilty. Ends
