ENGINEER Charles Kazibwe's Fiat lorry is to be auctioned to recover over sh4.1m he has failed to pay a Kampala businessman, Jackson Kalibbala.

By Catherine Ntabadde ENGINEER Charles Kazibwe's Fiat lorry is to be auctioned to recover over sh4.1m he has failed to pay a Kampala businessman, Jackson Kalibbala. Deo Nizeyimana, the Mengo Court chief magistrate, on November 17, 2000 ordered Kazibwe to pay Kalibbala sh4,147,145 he owes him and costs of the suit. Kalibbala's lawyers, Tumusiime, Kabega and Company Advocates, yesterday sent an attachment letter to Mengo Chief Magistrate's Court, stating their intention to sell off the Fiat 110 lorry UXC 583 to pay off their clients money. The letter, signed by Ronald Lukwebe of Mpina Associates, said, "By way of attachment and sale of the defendant's moveable property to wit motor vehicle UXC 583 Fiat 110." Kalibbala sued Kazibwe in September last year for non-payment of sh3m which he owed him as debt for buying the former's lorry. The suit claims that on October 19, 1999, Kazibwe without any right, sold off the fuel tank from Kalibbala's lorry. The suit said Kalibala approached Kazibwe and asked him why he had sold off his fuel tank but instead the latter offered to buy the lorry. Kalibbala stated that they decided on a price of sh6m, but Kazibwe paid only sh3m. Kalibbala further said that Kazibwe failed to pay the debt despite their repeated reminders until the matter was taken to court. Ends.
