MOSES Kasibante, who lost to Singh Katongole Marwaha in the recent parliamentary election for Rubaga North constituency, has filed a petition in court seeking to nullify Katongoleâ€™s election.
In a petition filed through Lukwago and Company Advocates in Kampala High Court last week, Kasibante said Katongole was not validly elected MP for Rubaga North.
The declaration of Katongole as Rubaga MP followed a contested vote recount done on February 28.
Kasibante wants court to nullify Katongoleâ€™s election and instead declare him (Kasibante) winner.
Kasibante argued that the recount done at the Mengo Chief Magistratesâ€™ Court was conducted in his absence and agents contrary to the Parliamentary Elections Act.
He said the recount cannot be considered because it was rejected and disowned by the Judiciary. The Judiciary disowned the recount, saying it was illegal and that the process was inconsequential.
Despite the Judiciaryâ€™s stand, the Electoral Commission (EC) has gazetted Katongole as Rubaga North MP.
On February 19, the EC declared Moses Kasibante winner in the Rubaga North race with 24,054 votes, while Katongole came second with 18,595 votes.
