Kabaziguruka bail hearing set for Thursday

The High Court in Kampala has today opened a Criminal Session of 50 capital offenders seeking to be released on bail pending trial.

Among the suspects is the jailed Nakawa Municipality Member of Parliament, Michael Kabaziguruka who is facing treason charges before the Court Martial and is set to appear before Justice Yasin Nyanzi on Thursday.

Another suspect is Makerere University Prof. Christopher Bakuneta who is accused of raping a university student in April this year.

Bakuneta, a lecturer at the Department of Natural Sciences, has presented three sureties who are his long-time friends and asked Justice Nyanzi to consider releasing him on a non-cash bail because he has spent five months on remand at Luzira Prison without pay.

The same Court has also set 12th October to hear an application filed by Ruhinda County MP Capt. Donozio Kahonda who is seeking orders from the High Court to suspend criminal proceedings that were instituted against him before Jinja Magistrate Court in October last year.

Kahonda is accused of forgery and uttering false documents at the Military Academy in Jinja in November/2001.

Other suspects who have applied to be released on bail are facing charges of murder, aggravated defilement and robbery but have told court that they have spent more than 3 years on remand without appearing before a judge for trial.

However, there was drama and tension in court on Tuesday morning when relatives of one of the suspects came to stand surety for him and could not trace him.

Suleiman Mayanja had been in Kigo Prison, but both Luzira and Kigo Prisons denied ever having him in custody.

This prompted Justice Nyanzi to issue a directive ordering Kigo, where the relatives last saw Mayanja in June, to produce him before court on Wednesday without fail.

The session is scheduled to end on Friday when Justice Nyanzi will consider whether to grant temporary freedom to the suspects.
