Court allows nominations in new constituencies

In a ruling delivered on Friday, Justice Musa Ssekaana dismissed the application with costs to the respondents, saying Muhumuza will not suffer any damage or loss if the election is conducted in the alleged ‘illegal’ constituencies.

The High Court has declined to grant an order, blocking the Electoral Commission (EC) from nominating any candidates for parliamentary elections from 89 new constituencies.

Lawyer Ben Muhumuza had filed an application against EC, Attorney General, and Minister of Local Government, in the Civil Division of the High Court, arguing that if candidates are allowed to be nominated it would render his main suit insignificant.

In a ruling delivered on Friday, Justice Musa Ssekaana dismissed the application with costs to the respondents, saying Muhumuza will not suffer any damage or loss if the election is conducted in the alleged ‘illegal' constituencies.

"In this case, the balance of convenience is not in favor of the applicant and has nothing to lose except for his personal interest allegedly on behalf of the entire public, which interest or damage will be considered after the court has determined the main cause," he said.

Justice Ssekaana said the nominees are representing their respective constituencies and serving a public good conducted in accordance with the law and representing the people in the Parliament.
