Govt reclaims land from illegal occupant in Kyambogo

A Man who has been occupying government's land illegally in Kyambogo, Nakawa Division has been evicted.

Boosa Tamalia and his agents have been occupying land  at FRV 1031 Fol 21 plots 892 and 893 for the last 20 years.

He was on Friday evicted by court bailiffs led by Moses Karugaba assisted by Uganda Police Force following a court order issued by Deo Nizemana, the deputy registrar execution and bailiffs division.

"This is to direct Karugaba Moses to remove Boosa Tamalia his agents/servants or any other person bond by this order and put Kyambogo University (judgment creditors) in possession of the same land.

This serves to direct the Police officers concerned that the execution is done in an orderly and peaceful manner," Nizemana's court order reads in part.

According to the undersecretary in the education ministry, Aggrey Kibenge, the 10 acres of land in question belongs to the ministry and in due course the ministry's headquarters would be built in Kyambogo.

He said Boosa has been adamant demanding sh2b before he and his family relocates.

"Staying in a place for 20 years does not make you the owner. How can you be paid for what you do not own? Kibenge told New Vision when contacted.  

He added that court confirmed to him he has no right of ownership.

"Eviction is as a result of court order after examining the claims of right of ownership," he said.

He explained that the ministry has delayed construction of its headquarters because of illegal occupants of the land.

"If he has any problem let him pursue it  with the courts of law," Kibenge advised Boosa.

Boosa and family speaks out

Boosa said he acquired the land in 1998 but could not divulge in detail how he obtained it.

"I am going to run to court," the 54-year-old Boosa said.

He said 14 households have been affected by the eviction and his eight members of the family.

"Why chase us away like dogs?" Monica Nankabirwa the wife to Boosa said as she shed tears."They should have given us a notice."

Margaret Namukwaya who has been making clay stoves wondered where she was going to get money from to pay school fees for her children.

A Six month pregnant Joan Babirye was left in bewilderment after she had paid Boosa sh520,000 rent for four months.

"I am stranded and I don't know where to go," a shocked Babirye said as she sat on a plastic chair surrounded by her belongings.
