MBARARA - Scuffle ensued at Global College of Business studies in Mbarara as police went into running battles with students when they had gone to execute an eviction order over rent arrears.
 
The scuffle started at around Wednesday midday when court bailiffs from Kitavuja General Agencies, together with Police ordered students of the college to pack their belongings and leave the premises.
 
Students proved to be resistant and refused to adhare to the order saying they have no where to go.

This forced Police to charge and gave them only five minutes to have vacate the premises but they (Police) still met resistence as students who had moved out of the gates started throwing stones at Police, which compelled Police to use tear gas to disperse the rebelious students.
 
According to sources, the school director, John Katongole's unpaid rent had accumulated to now sh50m.
 
Jackson Muwanga of Kitavuja General Agencies told New Vision the decision to forcefully eveict him came after the director of the college, John Katongole went into mediations with the owner of the premises and failed to agree.
 
"Last year the owner of the buildings filed civil suit in court and this year in April he secured the first eviction order but before it was executed, he ( the respondent), promised to start depositing money on the account but eventually refused, this prompted the owner to secure another order which we have executed on Wednesday, he has failed to pay rent for a year so we were instructed by court to give possession of vacant premises to the owner which we have done" Muwanga stated.
 
He adds that the school administration had been served with several notices through their lawyers from the owner of the premises, Bunny Wallia an Indian investor.
 
According to the warrant to give vacant possession of land dated June 13, 2018, as written to the court bailiffs reads, "whereas the under mentioned property in the occupancy of Global College of Business studies has been decreed to the plaintif you are hereby directed to remove any person bound by the order who may refuse to vacate the property to enable the bailiffs handover vacant possession to the plaintif without any interference from the defendant or its agent"
 
It further reads, "you are further commanded to return the warrant on or before July 13, 2018 with an endorsement certifying the day one which and manner in which it has been executed or the reasons why it has not been executed
 
Isaac Kambugu, the acting Mbarara district Police Commander in an interview noted they were called to witness the eviction process and to provide security.
 
He revealed that the due process was followed right from the land protection desk and as police they managed to talk to the students and the school administration prior about the eviction.
 
"However much the students wanted to become violent, we managed to contain the situation to see the process moves on well, because all the parties were aware, so the owner should come and take his properties and even the Bailifs should ensure that the thrown out properties are safe"
 
Some students say they were not aware of the eviction order, "This was a surprise attack we were neither informed by police nor the administrators that any time we are being evicted because we some of us we had just paid tuition, now all our books, clothes and documents have been thrown away, this is act is inhuman because we have no transport back home".
