Man sentenced to three years for robbery

A twenty seven year old man has been sentenced to three years and ordered to pay compensation to the complainant by Kaberamaido magistrates' court.

The ruling was done by the grade one magistrate Kaberamaido magistrate's court, Naunce Tumuhimbise.

The prosecution led by the Resident State Attorney Kaberamaido, Moses Atoe told court that on 7/04/2015, Joseph Ebagu Orech, a resident of Majengo ‘B' cell in Kaberamaido town council robbed Betty Aduo of her 300,000/= contrary to section 255 and 286 1(a) of the Penal Code Act.

Section 286 (1) (a) says that any person who commits the felony of robbery is liable on conviction by a magistrate's court, to imprisonment for ten years.

Prosecution further told court that the accused used a deadly weapon that caused grievous harm to the complainant.

Aduo testified before court that the accused used a lot of force and nearly killed her only to be saved by neighbours when she cried out for help.

While narrating her ordeal before court, she further said that she was later taken to Kaberamaido Health Center IV unconscious for treatment but had already recognized the suspect during the scuffle.

Tumuhimbise told Orech that he had a case to answer and was asked to make his prayer before the ruling could be made.

Orech asked court to give him a lighter sentence preferably a fine rather than being sent to prison.

He informed court that he had three nephews whose school fees he was paying and two old women who were under his care.

While delivering her ruling, Tumuhimbise noted that Orech had committed a violent offence.
"I agree with the state that this kind of offence is common in this community calling for a deterring sentence", Tumuhimbise said.

She later sentenced Orech to three years imprisonment instead of ten and ordered for the compensation of 320,000/= to the complainant.
