High Court okays hearing Besigye case at Kasangati

In the ruling court ordered the file be taken back to Kasangati Court

Kampala High Court has approved the Kasangati Magistrate Court to proceed with the hearing of the case in which former presidential candidate Dr. Kizza Besigye was seeking an order for police to be immediately and unconditionally removed from his home.

Recently, the Director of Public Prosecutions (DPP) Michael Chibita petitioned the High Court Criminal Division seeking for a review of the proceedings in the case file challenging some of the decisions that were taken by the trial Magistrate Prossy Katushabe.

In her ruling today, Kabanda agreed with the trial Magistrate's decision and ordered the file to be taken back to Kasangati Court and be immediately fixed for hearing.

Besigye contended that since February 18th, he had been arrested, detained and put under house arrest at his home beyond 48 hours without any charge preferred against him.

Shortly after the ruling Mpanga said that the ruling is a good step in his efforts to ensure that his client obtains his constitutional freedom.

When asked about the move by the Inspector General of Police (IGP) to withdraw police from Besigye's home and whether it had any bearing on the case, Mpanga said it will not justify the forty one days his rights have been violated by police.

 

IGP Gen. Kale Kayihura while addressing a presss conference this morning said police officers had been ordered to leave Besigye's home and instead keep monitoring him. 

Besigye sued Kayihura and Kampala North commander Wesley Nganizi under the Police Act.
