Nakawa High Court has ruled that former Kyambogo Vice Chancellor Prof. Isaiah Omolo Ndiege should return to the University

Justice Wilson Masalu Musene on Monday in his ruling quashed an earlier decision arrived at by Kyambogo University Council recommending the dismissal of Prof Ndiege.

Musene also issued an order directing the University Council to comply with the findings and recommendations of Parliament of Uganda which ordered the entire University management to be investigated by the office of the IGG, Auditor General and Directorate of Criminal Investigation.

“The disciplinary process is not only premature and illogical, but is riddled with procedure impropriety and should be stopped until constitutional bodies submit their reports after completing investigations into the alleged mismanagement of the University,” he added.

Musene told court that Council’s reason for removing Ndiege from office and sending him on forced leave was premature since investigations into the alleged mismanagement of the University were incomplete.

He ruled that the applicant (Ndiege) was not given a fair hearing which is against the principles of natural justice as provided under the constitution.

Musene said the internal disciplinary process has been injected with breaches of the Leadership Code Act 2002 (conflict of interest and abuse of office) with the IGG.

Musene further stated that having been on leave since September 15, 2012 to March 18, 2013 (6 month), sending the applicant on further leave for three months contravenes the Public Service Standing Orders 2010 and Kyambogo University terms and conditions of service 2005.
