URU has case to answer - Judge

The legal battle to have the Uganda Rugby Referee Society (URRS) case dismissed has flopped after High Court Judge Yasin Nyanzi told Uganda Rugby Union (URU) that they have a case to answer.


URRS sued URU for illegal suspension and conducting an illegal Special General Meeting (SGM) that suspended URRS and also formed another body called Uganda Council Referee (URC).

The referees, through their lawyers Odokel Opolot and Company Advocates, want Court to nullify the URU SGM and also quash the minutes of SGM that suspended their body.

URU lawyer Dan Wegulo, in his submissions, had urged that URU is neither a public body nor created by any statute and its acts or decisions cannot be subject to judicial review.

However, Justice Nyanzi quashed the argument saying that sports in Uganda is regulated and anybody running sports can be sued.

He adjourned the case to July 13, for hearing but ordered both parties to tender in their formal submissions by June 29 and a ruling is expected on August 21.

Meanwhile in another case in which sports fans sued Nakivubo board, KCCA and Attorney General, for sale of Nakivubo stadium to investor Ham Enterprises, Justice Eva Luswata adjourned it to October 5 and argued both parties to go for mediation.
