City lawyer Kasango acquitted of sh3b theft

The Buganda Road Court has acquitted a senior lawyer Bob Kasango of charges of theft of sh3.3b.

The Buganda Road Court has acquitted a senior lawyer Bob Kasango of charges of theft of sh3.3b.


Magistrate Simon Kintu acquitted Kasango of charges of forgery, uttering false documents and theft.

While delivering his judgment, Kintu said prosecution failed to adduce evidence that Kasango forged a letter to obtained sh3.3b on behalf of Best Kemigisha from government.

Prosecution had accused Kasango of receiving sh3.3b from government on behalf of Kemigisha for the land she sold. Prosecution said Kasango allegedly received the money but did not remit to Kemigisha.

Magistrate Kintu relied on the evidence of the handwriting expert who said he examined the signature on the forged letter attributed to Kasango and found that there were several   inconsistencies and he could not conclude who forged the document.

“There is confusion as to which letter was the one allegedly received by Kemigisha from the accused. Kemigisha talks of a letter dated September2008, the permanent secretary ministry of lands Gabindadde Musoke was shown a letter which was not dated and another letter dated November28, 2008.

The handwriting expert talks of a letter dated November25, 2008 so which is the letter that the accused allegedly forged as three of the letters mentioned raise a lot of doubt,”Zirintusa said.

Zirintusa said he did not find any evidence to warrant him to convict the accused on the charge of forgery.

On the charge of uttering false document Kintu said there was no evidence to corroborate the testimony of Kemigisha that it was Kasango who handed the letter to her and that her testimony could not be relied on.

Kintu said court could not also rely on the evidence of Kemigisha on the charge of theft because it was full of contradictions.

 “It is worth noting that Kemigisha in her statement made at police denied receiving any money from the accused however in her additional statement she stated that after obtaining bank account she received some money on her account this raises a lot of doubt in prosecution case,” Kintu said.

Outside court Kasango said he was shocked by the accusation put against him yet he has always dealt with his clients professionally without acting in a deceitful manner.
