Court blocks new LDC exam probe again

Court has issued an interim order stopping the newly constituted committee by the LDC which has been investigating alleged examination malpractices at the centre.

KAMPALA - The Court of Appeal has issued an interim order stopping the newly constituted committee by the Law Development Centre (LDC) which has been investigating alleged examination malpractices at the centre.

The new committee headed by Dr. Pamela Kalyegira was supposed to conclude its work by April 30.

The first committee which was headed by retired Judge Kania was stopped by court last month on grounds that it had no jurisdiction to carry out its investigations because it was appointed in violation of Section 16 of the LDC Act.

The temporary order was secured by the two embattled city lawyers, Michael Mabikke and the East African Legislative Assembly legislator, Mukasa Mbidde.

The two are part of the fifteen former students of LDC implicated in the exam scam.

“The respondent’s committee appointed to review the recommendations of the report of the forensic audit of the bar course examination for the period 200/2005 to 2010/2011 be restrained from carrying out its work pending the hearing and final disposal of the main application for stay of execution,” the order issued by Court of Appeal Registrar, Erias Kisawuzi reads in part.

He noted that the interim order will be in force for 30 days or until further orders by court.

Mabikke and Mbidde said that there is still a main suit in the High Court on the same matter, arguing that leaving the proceedings of the committee to continue will render the substantive application for stay of execution and intended appeal nugatory.

They also argue that LDC went ahead to institute another probe committee without extracting a court order.

When contacted, LDC’s spokesperson, Hamis Lukyamuzi confirmed receipt of the copy of the judgment and are only awaiting the outcome of the main application.

The main application is fixed for hearing on April 11.
