A 40-year-old man was on Monday charged with defiling his daughter. Lauben Tumwebaze, a businessman in Biharwe, Nyamuyanja sub-county, Isingiro district, is suspected to have defiled his 14-year-old daughter knowing he was infected with HIV/AIDS.

The Mbarara Grade One Magistrate, Patrick Talisuna, heard that Tumwebaze defiled his daughter twice. The court also heard that Tumwebaze first defiled the girl in April in a banana plantation on their way from his shop.

Prosecution said Tumwebaze allegedly threatened to kill the girl if she reported him. The court heard that the second time, the suspect, on May 18, defiled his daughter at their home while his wife was attending a funeral and her siblings were asleep.

The victim later told her mother who reported to the LCs and the Police, leading to Tumwebaze’s arrest. Tumwebaze, however, claimed that he was being framed by his wife, insisting that he did not defile his daughter.

“I started having problems with my wife after I misappropriated the money she entrusted me with from the sale of land,” Tumwebaze said.

Talisuna, however, did not allow him to enter plea because of the nature of the offence, saying the case was beyond his jurisdiction and can only be tried by the High Court.

The case was adjourned to May 11, while Tumwebaze was sent back on remand at Mbarara Prison.
