Uncle gets 10 years in jail for defilement

A 62-YEAR-OLD man, who turned his orphaned 11-year-old niece into his wife, has been jailed for 10 years by the High Court in Luwero district.

A 62-YEAR-OLD man, who turned his orphaned 11-year-old niece into his wife, has been jailed for 10 years by the High Court in Luwero district.

Prosecution, led by the Luwero resident state attorney, Bernard Senteza, told the court that Peter Kagezza of Lwetunga village in Nakaseke district, a maternal uncle of the victim, committed the offence between 2006 and 2008.

Senteza urged the court to give Kagezza the death penalty, saying he had inflicted mental and physical torture on the victim by defiling her.

He further said the accused was supposed to guide and guard his niece, but instead sexually molested her, permanently affecting her future sexual life.

However, Kagezza’s lawyer, Sawadi Katamba, asked the court for lenience, saying his client was a first-time offender, had been on remand for two-and-a-half years and was of advanced age.

Justice Elizabeth Musoke noted that cases of defilement were on the increase in the Luwero magisterial area and said there was need to protect defenceless victims by putting the offenders out of circulation.

The judge said although the maximum sentence was death, she gave the accused a 10-year imprisonment due to the mitigating factors.

Kagezza will serve the jail term in Nakasongola government prison. Meanwhile, the court sentenced a 30-year-old polygamous man to 13 years in prison for defiling a nine-year-old pupil.

The prosecutor said Sunday Kasule, a resident of Luteete village in Luwero, gave the child sh100 and told her not to tell anybody that he had defiled her.

The victim, however, told her guardians, who reported the matter to the Police, leading to Kasule’s arrest.
