DEFENCE minister Amama Mbabazi yesterday lost an application in which he had requested the Court of Appeal to review its judgment and exonerate him from paying costs to James Garuga Musinguzi.

DEFENCE minister Amama Mbabazi yesterday lost an application in which he had requested the Court of Appeal to review its judgment and exonerate him from paying costs to James Garuga Musinguzi.

“The court’s order granting costs against Amama Mbabazi was justified under section 27 of the Civil Procedure Act, because he lost the appeal and the order granting costs followed the event,” the judges said in a ruling read by registrar J.B. Seggiriinya.

The justices, Laetitia Mukasa-Kikonyogo, the deputy Chief Justice, Galdino Okello and Christine Kitumba, had also dismissed Mbabazi’s petition appeal as they confirmed a High Court decision nullifying his earlier election.

They said, “Apart from the errors resulting from accidental slip herein corrected, the application, seeking to set aside the judgment is dismissed with costs, which we put at four fifth of the application.”

Mbabazi had asked the court to correct the qualitative test it applied in its judgment, saying it was an error of law, which occasioned injustice to him.

Mbabazi regained his seat as Kinkizi West MP when Musinguzi pulled out during the recent by-elections.
