A High Court judge has criticised a city Grade One magistrate for convicting and sentencing a Nigerian to a-six-months imprisonment using a defective charge sheet.
Vincent Rwamisazi Kagaba also blamed the magistrate J. B. K. Byarugaba, for going against the sentencing policy by denying Michael Uchenna the option of a fine, which was provided for in the law.
The judge was on Friday quashing and setting aside the sentence at the High Court in Kampala. Uchenna was sentenced to six months imprisonment.
Uchenna petitioned the High Court, arguing that the magistrate was wrong to impose a jail term where the law provided for a fineand imprisonment in default.
Nyakana felt the convict had been treated harshly.
