THE Top TV FC case against relegation took a new turn yesterday after lawyers of Federation of Uganda Football Associations (FUFA) made an application disputing the High Court’s power to decide football matters.

Trial judge Justice Richard Okumu-Wengi set November 11 to hear and rule on the pre-trial application on whether or not he has the jurisdiction over football matters.

FUFA lawyer Patrick Furah in a change of defence raised the preliminary objection saying that football disputes can not be a subject of litigation in ordinary courts. Furah was responding to Top TV’s suit challenging it’s demotion from the Super Division.

Furah said that FUFA is an affiliate of FIFA whose statutes bar disputes arising between national associations and its’ affiliates from going to the ordinary courts.

“The defendant (FUFA) is a member of Federation of International Football Association (FIFA) and that its’ membership is voluntary any affiliate has to abide with FIFA’s constitution and statutes which bar disputes arising between National associations and its’ affiliates from going to ordinary courts of law,” Furah said.

Okumu-Wengi asked if the FIFA statutes had been ratified by Uganda— Furah answered in the affirmative.
