Court to hear IGG’s plea on Mutale suit

COURT has accepted to hear an application by the IGG, Jotham Tumwesigye, to defend the dismissal of former presidential adviser Major Kakooza Mutale.

COURT has accepted to hear an application by the IGG, Jotham Tumwesigye, to defend the dismissal of former presidential adviser Major Kakooza Mutale.

Justice Yorakamu Bamwine yesterday overruled objections by Mutale and Attorney General Francis Ayume to allow Tumwesigye’s application on grounds that the case had been concluded.

Bamwine said the case was not yet over because Ayume had not yet presented the defence and that it was still possible for a party to join the case.

“The appeal isn’t yet over until the defendant (Attorney General) has presented his case. The trial isn’t complete since the defence hasn’t yet been presented. In the final result both objections are overruled,” Bamwine said.

Tumwesigye wants to join the appeal as a respondent, on grounds that Ayume failed to put a strong defence against Mutale.

Bamwine said the fate of Tumwesigye’s application depended on whether the latter can sue or be sued and can pay legal costs.
