CONSERVATIVE Party president John Ken Lukyamuzi has said it is unconstitutional for Justice Faith Mwondha to resume duty as Inspector General of Government (IGG) before the Constitutional Court has disposed of the petitions relating to her re-appointment.

Mwondha was re-appointed by President Yoweri Museveni, but she refused to appear before the appointments committee for vetting. The matter is now before the Constitutional Court.

“Nobody is above the law. Acting outside the law is an embarrassment to the judicial profession,” Lukyamuzi said while addressing a press conference in Kampala yesterday.

“She may continue earning her salary but that does not correct the constitutional error attached to her re-appointment,” he added. Mwondha returned to her office from her annual leave on Wednesday.

In 2005, Mwondha, as IGG, forced Lukyamuzi to vacate his parliamentary seat and banned him from standing for public office again for failure to declare his wealth as required by the Leadership Code.

Lukyamuzi sought to overturn the decision, but he is still battling with the case in the Supreme Court.

Information minister Kabakumba Masiko said she did not know how Mwondha had returned to office.
