Express turn guns on NCS, education ministry

WITH their case against FUFA officials yet to be heard, Express Football Club has challenged the Ministry of Education and Sports to ensure all national sports bodies are properly recognised in Ugandan law.<br>

WITH their case against FUFA officials yet to be heard, Express Football Club has challenged the Ministry of Education and Sports to ensure all national sports bodies are properly recognised in Ugandan law.

Through Muwema and Mugerwa Advocates and Solicitors, Express have written to Education and Sports minister Namirembe Bitamazire explaining their case against FUFA officials filed last week.

Express asserts that, among other claims, the body of FUFA as it appears today is illegally constituted because there are no regulations in place to provide for its (FUFA) existence as prescribed by the National Council of Sports (NCS) Act.

They particularly challenged state sports Minister Charles Bakkabulindi and NCS general secretary Jasper Aligawesa, who insist FUFA and all associations are legal entities.

“The question of the legality of sports associations is a fundamental one which is not well understood and is casually handled at your ministry,” the letter states.

“This state of affairs is responsible for the above stated oblique views held by some of your officials which contradicts the law.

“It is the responsibility of your ministry to act within the law and cause all those it regulates like sports associations to be compliant with the law.”

“Since 1964, the NCS has operationalised its supervisory and regulator functions as regards sports associations albeit without the enabling legal instrument to bring National Associations into legal existence as required.”

“We invite your esteemed office to act expeditiously and issue the statutory instruments for the establishment and registration of National Sports Associations to prevent the need for present and future court action.”
The case will be heard in the next couple of days.
