Dismiss Gasasira appeal â€" IGG

THE Inspector General of Government (IGG) has asked the High Court to dismiss an application in which health ministry accountant Nestor Machumbi Gasasira is seeking to stop his dismissal over undeclared wealth.

THE Inspector General of Government (IGG) has asked the High Court to dismiss an application in which health ministry accountant Nestor Machumbi Gasasira is seeking to stop his dismissal over undeclared wealth.

Gasasira, who was interdicted on the recommendation of the Solicitor General, yesterday asked the court to stop his interdiction until his pending appeal is heard.

The High Court Registrar, Isaac Muwata, who heard the application, set December 1, for the ruling.

Earlier, the principal state attorney, Vincent Kasuja, who represented the IGG, objected to Gasasira’s application. He argued that even the initial temporary order, which the court granted to him, had been wrongly filed in court.

The attorney also said the application had been brought in bad faith to stifle the inspectorate from executing its duties.

Gasasira’s lawyer Geoffrey Kandeebe, however, said no civil rule of procedure was violated in filing the application.

Court has an inherent power to grant an interim order where it feels that there is an aggrieved party, Kandeebe added.

The IGG wants Gasasira dismissed for failing to explain the source of his wealth.

An investigation into Gasasira’s wealth revealed that he made false declarations, which contravenes the Leadership Code.

The IGG further wants his wealth seized and him barred from holding public office for the next five years.

The inspectorate also asked Uganda Revenue Authority to audit the trading activities of Sagimex Enterprises, one of Gasasira’s businesses, and recover any taxes due to the Government.

Gasasira, however, said he submitted declarations of his income, assets and liabilities as required by the Leadership Code from 2002 to 2007.

Gasasira’s properties queried by the IGG include a residential house in Nyakabale, Kisoro district, a house on Neptune Avenue, flats at Banda, Kyambogo, a plot on Lake Drive Luzira, a plot on Luthuli Avenue Bugolobi, land at Bukoto Cresent, a land Cruiser and a block making machine.
