Court declines security for Rwakoojo case

THE petition by UPC stalwart Henry Mayega challenging the re-appointment of the Electoral Commission Secretary, Sam Rwakoojo will be heard without him depositing any security for costs.

The High Court on Thursday rejected the application by the Electoral Commission, Rwakoojo to order Mayega to pay sh50m before the case is heard.
Justice Elizabeth Musoke ruled that the case was of public interest and saddling it with orders for security for costs could frustrate it.

Mayega, who is eyeing presidency in 2011, dragged the Electoral Commission and Rwakoojo to court over Rwakoojo’s reapointment which took effect after his previous term expired on December 17.

Mayega through his lawyers, Michael Akampurira and Nester Byamugisha contends that Rwakoojo was wrongfully re-appointed to a post for which he is not qualified.

The lawyers also applied for a judicial review of the appointment orders and said Rwakoojo was appointed without the approval of the Public Service.
