ABDUL Balingira Nakendo has lost his Bukhooli North seat for lack of academic qualifications.

The Supreme Court ruling confirmed the earlier ones by the High Court and Court of Appeal nullifying his election.

Justice Bart Katureebe said: “The Court of Appeal was justified in confirming the decision of the trial court that the certificates considered by the National Council for Higher Education were no certificates at all.”

He blamed the council for acting unreasonably and without due diligence.

“I see no reason to interfere with the findings of the Court of Appeal on this matter. I dismiss this appeal with costs to the respondent,” Katureebe added.

Patrick Mwondha, UPC, who contested for the seat with five others including Nakendo, successfully petitioned the High Court in 2006 and proved that Nakendo had not obtained the minimum academic qualification to represent the people of Bukhooli county.

Nakendo, (NRM) however, unsuccessfully appealed to the Court of Appeal but lost.

Nakendo had maintained that he was duly qualified for election and that he had been validly nominated to participate in the elections.

The Chief Justice, Benjamin Odoki, headed the panel.

The other justices were John Wilson Tsekooko, Joseph Mulenga and George William Kanyeihamba.
