THE Court of Appeal has upheld a 10-year imprisonment sentence against a teacher of Nakasongola Roman Catholic Primary School for defilement.

reports that Fred Balimubitawa had appealed against the conviction by Justice Vincent Kagaba of the High Court, arguing that the evidence was not properly evaluated.

“The trial judge was right in convicting the appellant. We find no merit in his appeal, which we dismiss,” the appeal court ruled.

Justices Stephen Engwau, Amos Twinomujuni and Stephen Kavuma made the judgment.

Balimubitawa was found guilty of the offence in October 2006 on the grounds that the victim, a P6 pupil, knew him very well. He also committed the act in broad daylight, so his identity could not be mistaken.
